1. Acceptance of Terms

By accessing or using TrackTrade ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

TrackTrade provides trading analytics, journaling, backtesting, and performance tracking tools. The Service is designed to help traders record and analyze their trades. TrackTrade is not a brokerage, financial advisor, or investment service.

3. User Accounts

You are responsible for safeguarding your account credentials and any OAuth tokens connecting third-party platforms. You must immediately notify us of any unauthorized access to your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' data
• Upload malicious content or files
• Reverse-engineer, scrape, or extract data from the Service
• Use the Service in a manner that could damage, disable, or impair its functionality

5. Intellectual Property

The Service, including its design, features, and code, is owned by TrackTrade and protected by intellectual property laws. You retain full ownership of your trading data, journal entries, screenshots, and any content you upload.

6. Third-Party Integrations

The Service integrates with third-party platforms such as Tradovate, Google (Gmail, Firebase), and OpenRouter (AI). Your use of these integrations is subject to the respective third-party terms of service. We are not liable for the availability, accuracy, or actions of third-party services.

7. Disclaimers

No investment advice. TrackTrade does not provide financial, investment, or trading advice. All analytics, AI reviews, and backtest results are for informational and educational purposes only. Past performance and hypothetical results are not indicative of future results.

As-is basis. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Data accuracy. We do not guarantee the accuracy of parsed trade data, market data feeds, or analytics calculations. Always verify important information independently.

Trade copier. The Service may include a trade copier feature that allows you to replicate your trades to additional trading accounts. This feature is provided as a convenience tool only. TrackTrade does not guarantee the accuracy, timing, or successful execution of copied trades. Delays, slippage, partial fills, connection failures, or differences between accounts may result in different outcomes than the original trade. You are solely responsible for all trades executed on your accounts, including those placed via the trade copier. TrackTrade shall bear no responsibility whatsoever for any financial losses, damages, or consequences resulting from the use of the trade copier feature.

Trading automation risks. Automated trading systems, including the trade copier, involve inherent risks including significant financial loss. Predetermined algorithms may not fully adapt to changing market conditions, making them unsuitable for some investors. Assess your financial situation and risk tolerance before using any automation features.

No signals or advice. TrackTrade does not provide alerts, signals, research, analysis, or trading advice of any kind. The platform assists traders in making their own decisions and is provided "as-is" without any warranty. Scripts, indicators, and strategies produced or displayed within TrackTrade are for informational or educational purposes only.

User responsibility. Using TrackTrade's automation features safely requires experience and skill. Even experienced users face risks. By using TrackTrade, you acknowledge and assume these risks, releasing and indemnifying TrackTrade, its operators, associated companies, vendors, licensors, and employees from any claims or damages arising from your use. You are responsible for monitoring your positions and ensuring that your signals and trades are successfully processed.

8. Limitation of Liability

To the maximum extent permitted by law, TrackTrade and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service, including but not limited to losses resulting from trading decisions made based on information displayed in the Service.

9. Indemnification

You agree to indemnify and hold harmless TrackTrade from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Account Deletion

You may delete your account and all associated data at any time from the Settings page. Upon deletion, all your personal data, trading records, journals, and integrations will be permanently removed within 30 days.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

12. Modifications

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms with a new "Last Updated" date. Continued use after changes constitutes acceptance of the modified Terms.

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Israel. Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Tel Aviv, Israel.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
